Can I file a glass claim with my insurance when I'm not at fault?

My car was hit by a piece of a semi trailer that fell off while I was driving behind it. I have received a settlement from the insurance of the guy driving the truck, but I am wondering if I can also have the windshield covered by my insurance.

I know that in Oregon glass claims are a No Liability claim, but I am not sure if I can have my insurance cover the glass after I received the settlement. Seems like I should be able to, after all I pay them to cover damages.

I'd be careful with that one because that could be considered insurance fraud. But....you should be able to make a claim. It can raise your rates though so I would check. Also, most of the time there is a deductable amount you have to pay for the repair.

i agree with Astrid.   you can't claim twice for the same thing and if you succeeded and were found out which they would you could face serious charges as well as being blacklisted with all insurance companies.as well as paying for the deductible and possibly affecting your rating.    i know it may be tempting and there are probably a lot of people out there who have done it.    possibly ring your insurance company and ask them.   please be responsible and don't do it, it could come back and bite you down the track.    be thankful that the semi driver took responsibility for the damage he did, there are a lot out there who would not have bothered,

I believe you cant, specially if you already settled with the trucks insurance. If they paid to cover your windshield repair, you cant ask your insurance for it. Unless you can prove that the other company never paid you, but you would need police reports and what so ever. If you settled why do you need your insurance to cover it?

You can try but if they find out you already received money for the damages, they will drop you as a policyholder.

If you've already received settlement for the damage, why would you also want to claim it on your insurance.  Double dipping is fraud and these types of situations are a small reminder of why everyone's insurance rates are way too high!!
